Terms of Use
Last updated: June 2025 · The Living Brand Pty Ltd (ABN 27 353 663 124)
Welcome to thelivingbrand.com.au (the “Site”), operated by The Living Brand Pty Ltd (ABN 27 353 663 124) (“The Living Brand”, “we”, “us”, “our”). By accessing or using the Site, you agree to these Terms of Use. If you do not agree, please do not use the Site.
1.About these terms
These Terms of Use govern your access to and use of the Site and its content. They do not cover the separate terms of any paid services we provide to clients, which are set out in a separate services agreement or proposal. If there is any inconsistency between these Terms and a signed services agreement, the services agreement prevails for that engagement.
2.Using the Site
You may use the Site for lawful purposes only. You agree not to:
- Use the Site in any way that breaches any applicable law or regulation
- Attempt to gain unauthorised access to the Site, its servers, or any connected systems
- Introduce any malicious code, or interfere with the proper working of the Site
- Copy, reproduce, or republish Site content except as permitted in Section 4
- Use the Site to transmit unsolicited or unauthorised advertising
3.Strategy sessions and enquiries
Booking a free strategy session or submitting an enquiry does not create a contract for services. Any engagement to provide paid services will be governed by a separate written agreement or proposal. Information provided during a strategy session is general in nature and tailored to the information you share; it does not guarantee any particular business outcome.
4.Intellectual property
All content on the Site — including text, graphics, logos, the “The Living Brand” name and branding, frameworks (including the five-pillar growth system), images, and design — is owned by or licensed to The Living Brand and is protected by Australian and international intellectual property laws.
You may view, download, and print Site content for your own personal, non-commercial use. You may not otherwise reproduce, distribute, modify, or commercially exploit any content without our prior written permission.
Free resources we provide (such as guides and checklists) are for your own use. You may not resell or redistribute them.
5.No guarantees on results
Our content, including case studies, statistics, and resources, is provided for general information. While we describe outcomes we aim to achieve and approaches that have worked, past or illustrative results are not a guarantee of future results. Every business is different, and outcomes depend on many factors outside our control. Nothing on the Site constitutes a guarantee of any specific result, revenue, or return.
6.Information is general only
Content on the Site is general information and does not constitute professional, financial, legal, or business advice tailored to your circumstances. You should obtain your own professional advice before acting on anything you read here. We are not liable for any action you take based on Site content alone.
7.Third-party links
The Site may contain links to third-party websites or resources. We provide these for convenience only and do not endorse, and are not responsible for, the content, products, or practices of any third-party site. Accessing third-party sites is at your own risk.
8.Australian Consumer Law
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy you have under the Competition and Consumer Act 2010 (Cth) (including the Australian Consumer Law) or any other law that cannot lawfully be excluded. Where our liability cannot be excluded but can be limited, our liability is limited to the maximum extent permitted by law.
9.Limitation of liability
To the maximum extent permitted by law, and subject to Section 8:
- The Site and its content are provided “as is” and “as available”, without warranties of any kind, express or implied
- We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components
- We are not liable for any indirect, incidental, special, or consequential loss, or for any loss of profit, revenue, data, or goodwill, arising from your use of (or inability to use) the Site
10.Indemnity
You agree to indemnify us against any claim, loss, or expense arising from your breach of these Terms or your misuse of the Site, to the extent permitted by law.
11.Changes to the Site and these terms
We may change, suspend, or discontinue any part of the Site at any time without notice. We may also update these Terms from time to time; the current version will always be published on this page with the “Last updated” date revised. Continued use of the Site after changes means you accept the updated Terms.
12.Governing law
These Terms are governed by the laws of the State of Victoria, Australia. You submit to the non-exclusive jurisdiction of the courts of Victoria and the Commonwealth of Australia.
